STYLEWARE

Styleware is the trading name of Styleware Pty Ltd, a company registered in Australia with ACN 612 314 075.

PRODUCT DESCRIPTIONS

We strive to ensure that our products are described as accurately as possible, however we do not warrant that the description is accurate. Where we become aware of any misdescription, we reserve the right to correct the error or omission.

Our product images have been provided for illustrative purposes only and we do not guarantee that any image will reproduce in true colour nor that any given image will reflect or portray the full design or options relating to that product.

PRICING

All prices are in Australian dollars and are inclusive of GST. Prices are subject to change.

ORDERS

Items in a shopping cart do not represent a completed order. We cannot reserve items that are left in your cart…. so don’t delay! An order must be placed, and payment accepted by Styleware to constitute a completed order and all orders are subject to availability. If an order is received that cannot be filled, Styleware will refund the amount debited for that item to your nominated bank account as soon as practical.

Once an order has been placed, we are unable to make changes or edits to the order or combine it with other orders. Styleware may exercise its discretion to cancel an order or refuse to process an order for any reason including; unavailability of a product, inability to deliver to nominated delivery address or suspicion that the order is not genuine.

We strive for perfection, however where a product has been listed at the incorrect price or with incorrect descriptive information or image due to an error or oversight, we reserve the right to cancel that part of the order or the entire order. Should this unfortunate event occur, we will refund the relevant amount debited to your nominated bank as soon as practical.

PAYMENTS

We take reasonable care to make our site secure. We accept payments by Pay Pal, Afterpay and Credit Card (Stripe). Payment will be debited and cleared from your account upon order of your Styleware product. For Afterpay terms and conditions please head to https://www.afterpay.com/en-AU/terms-of-service.

To the extent permitted by law, we will not be held liable and responsible for any damages or consequential loss (whether direct or indirect) suffered by you as a result of any credit card fraud or unauthorised access to an Afterpay or Paypal account.

We will not be held liable or responsible for any additional charges imposed by your credit card provider or bank.

GIFT CARDS

Styleware gift cards are valid for 36 months from the date of purchase and can be purchased as electronic (emailed) gift codes, to be sent either to yourself or to your lucky recipient on a date of your choosing, woohoo!

Gift cards can only be redeemed via Styleware’s online store and are not able to be used in conjunction with Afterpay. Gift cards may be redeemed during sale and promotional periods; however, sale and promotional pricing does not apply to the purchase of gift cards and you cannot purchase a gift card with another gift card.

If the amount of your gift card does not cover the total order amount, you will need to pay the remainder of the purchase using another payment method. If the amount of your gift card is more than the total order amount, the balance will remain on your gift card for your next purchase using the same gift card code.

Online gift cards are non-transferable, non-refundable and are not redeemable for cash. Unfortunately, we cannot replace a lost or stolen gift card, nor can we extend expired gift cards.

SALES & PROMOTIONS

Once an order has been placed for an item on sale or using a promocode you are not able to make changes to orders or combine separate orders.

Only one promocode or sale offer can be used per order.

Promocodes can only be used once, are not transferrable and are not able to be used to purchase gift cards.

All promo / sale orders are final, there are no refunds, exchanges or credit notes on sale items or promos/promocodes.

If a promocode or sale can’t run properly because someone or something is spoiling the fun for everyone – e.g. fraud, tampering, technical errors or anything else that is beyond our control that affects the running or fairness of the promocode or sale – we can cancel, modify or suspend the promocode or sale.

NEW SUBSCRIBER SIGN-UP DISCOUNT

From time to time, Styleware may offer a discount to new subscribers. The discount may take the form of a monetary amount or a percentage discount or any other such offer as Styleware deems appropriate.

If a discount is available, it may be advertised in the website subscriber pop-up and / or in the new subscriber welcome email, where you will be provided with instructions on how to access the discount.

Subscriber Discount terms:

• Any discount and conditions in addition to the above will be provided via email.
• Can only be used once and is non-transferable
• Minimum spend required, apply the discount code at checkout.
• New subscribers will be emailed the code.
• Cannot be used in conjunction with other offers.
• All other sale and promotion T&Cs apply (see above).

PRIVACY

Your privacy is important to us, and we only collect and keep information that you provide to us that is essential in completing a successful transaction with you. By creating an account with Styleware or registering your details with Styleware, you give us the authority to contact you in the future with any promotional emails, exclusive sale offers and new product updates. You will be able to opt out of this correspondence upon receipt.

Mobile Message Service Terms and Conditions

The Styleware mobile message service (the “Service”) is operated by Styleware. Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Styleware’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Styleware through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Styleware. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Reply with the single keyword command STOP or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other For Service support or assistance, email hello@styleware.com.au.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honouring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

YOUR COMMITMENTS

You warrant that all information provided by you is correct and accurate, and you are properly authorised to enter into an agreement with Styleware for the purchase of goods. You will not share your Styleware account details, nor use the Styleware account of another individual.

WEBSITE USE

You are provided with access to and are authorised to download material contained on this website for your personal use only. You may not, without our written permission, on-sell any information obtained from this website, use any data mining robots, other extraction tools, metatags or mirror the website. Further, you must take your own precautions to ensure that the process which you employ for accessing this website does not expose your computer to the risk of viruses, malicious computer code or other forms of interference which may cause damage to your computer software. We take no responsibility for any interference or damage to your computer system that arises out of or in connection with your use of this website.

This website may contain links to other websites that are operated. We operate and manage social media accounts on Facebook, Instagram and Pinterest and we may use other social media channels in future.

We do not endorse the opinions expressed by the users on our social media pages.

By submitting content, you agree that we may use and reproduce this content including your name, for testimonial, or other purposes in any media and without any compensation to you.

You must not post any material that is defamatory, derogatory, racist, sexist, unlawful, obscene, infringing on any third party’s intellectual property rights, breaching someone else’s confidentiality or privacy, misrepresenting your relationship with us or this website, misleading, false or deceptive on our social media pages.

We reserve the right to edit or remove content that violates these terms and to block your access to our page.

If you upload any material or content on our website or social media accounts, you grant us an irrevocable, royalty-free licence to use and reproduce that material or content. Having said that, we do not claim ownership of intellectual property rights in respect to user content.

In addition, Styleware shall only be liable to you for losses up to 100% of the total value of goods purchased.

GOVERNING LAW

These terms and conditions and all transactions on the Styleware website are governed by the laws of Western Australia, Australia. All terms and conditions are subject to applicable law. To the extent permitted under law, we disclaim any liability under relevant consumer or other legislation and regulation.

Styleware reserves the right to change its terms and conditions without notice.
