TERMS AND CONDITIONS

These Terms & Conditions apply to your use of the Styleware website and purchases made through styleware.com.au. By accessing our website or placing an order with Styleware, you agree to these Terms & Conditions.

STYLEWARE

Styleware is the trading name of Styleware Pty Ltd, a company registered in Australia with ACN 612 314 075.

PRODUCT INFORMATION

We take care to ensure our products are described and displayed as accurately as possible. From time to time, however, product descriptions, specifications, pricing, availability or other information may contain errors or omissions. Where we become aware of an error, we reserve the right to correct it.

Product images are provided for illustrative purposes. We take measures to represent colours as accurately as possible; however, colours may appear differently depending on individual screens, devices and display settings.

Product dimensions, capacities and other specifications may be approximate unless otherwise stated.

PRICING & CURRENCY

Prices displayed on our website may vary depending on your location and the currency selected or presented by the website.

For Australian customers, prices are generally displayed in Australian dollars (AUD) and include GST where applicable.

For customers shopping from other countries, including the United States and New Zealand, prices may be displayed in the applicable local currency. Any applicable taxes, duties and shipping charges will be displayed or otherwise communicated during checkout in accordance with our Shipping & Returns policy.

Prices, promotions and offers are subject to change without notice.

ORDERS

Items added to your shopping cart are not reserved and do not constitute a completed order.

An order is considered placed once checkout has been completed and payment has been accepted. All orders are subject to product availability and acceptance by Styleware.

Once an order has been placed, we may be unable to amend, combine or otherwise alter the order due to our fulfilment processes.

Styleware reserves the right to cancel or refuse an order where reasonably necessary, including where:

  • A product is unavailable.

  • We are unable to deliver to the nominated address.

  • Payment cannot be authorised.

  • We reasonably suspect fraudulent or unauthorised activity.

  • There has been an error in pricing, product information, availability or promotion details.

If we cancel an order after payment has been processed, the relevant amount will be refunded to your original payment method.

PAYMENT

Available payment methods are displayed at checkout and may vary depending on your location.

Payment is required at the time an order is placed unless otherwise stated.

Payments are processed securely through our ecommerce platform and third-party payment providers. Styleware does not necessarily receive or store complete payment card details.

Your bank, card issuer or payment provider may apply additional fees or currency conversion charges. These charges are outside Styleware's control and are the responsibility of the customer.

SHIPPING & DELIVERY

Styleware currently ships directly to Australia, New Zealand and the United States.

Shipping rates, estimated delivery timeframes, duties and tax information are set out in our Shipping & Returns Policy.

Delivery timeframes are estimates only and commence once an order has been dispatched. Delivery may be affected by carrier delays, customs processing, peak periods, weather events and other circumstances outside our reasonable control.

Once your order has been dispatched, tracking information will be provided where available.

RETURNS, REFUNDS & EXCHANGES

Returns, refunds and exchanges are subject to our Returns & Refunds Policy and Shipping & Returns Policy.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under applicable consumer law.

GIFT CARDS

Styleware gift cards are valid for 36 months from the date of purchase, unless otherwise required by applicable law.

Gift cards can be redeemed through Styleware's online store.

Gift cards may be used during sale and promotional periods unless otherwise stated; however, discounts and promotional pricing do not apply to the purchase of gift cards.

Gift cards cannot be purchased using another gift card.

If the value of your gift card does not cover the full order amount, the remaining balance must be paid using another available payment method. Where the gift card value exceeds the order total, the remaining balance will remain available on the gift card for future purchases.

Gift cards are not redeemable for cash except where required by law.

Please see our Returns & Refunds Policy for information about refunds on orders paid for using a gift card.

SALES & PROMOTIONS

From time to time, Styleware may offer sales, discount codes, free gifts, free or discounted shipping, subscriber offers and other promotions.

Promotions may be subject to additional terms and conditions, including:

  • Promotional start and end dates.

  • Minimum spend requirements.

  • Eligible products or customers.

  • Geographic restrictions.

  • Stock availability.

  • Limits on the number of uses per customer or order.

  • Exclusions from other promotions or discount codes.

  • Specific shipping conditions.

Unless otherwise stated, promotional thresholds are calculated on the qualifying merchandise value after discounts and before shipping charges.

Unless otherwise stated, only one discount code or promotional offer may be applied to an order.

Promotions cannot be applied retrospectively to orders placed before the applicable promotional period.

Promotional offers have no cash value and cannot be redeemed for cash.

Where a promotion is affected by fraud, misuse, technical error or circumstances outside our reasonable control, Styleware reserves the right to modify, suspend or cancel the promotion, subject to applicable law.

Sale and promotional purchases remain subject to our Returns & Refunds Policy and applicable consumer law.

FREE GIFTS WITH PURCHASE

From time to time, Styleware may offer complimentary gifts when an order reaches a specified qualifying spend.

Unless otherwise stated:

  • Free gifts are available while stocks last.

  • Limit of one applicable gift per qualifying order.

  • Gifts have no cash value and cannot be exchanged or substituted.

  • The qualifying spend is calculated after discounts and before shipping.

  • A gift must be added or selected in the manner specified for that promotion.

If an order containing a free gift is subsequently returned for change of mind and the retained value of the order no longer meets the qualifying threshold, the free gift must also be returned unused and in resaleable condition.

If the applicable free gift is not returned, its stated retail value may be deducted from the change-of-mind refund where permitted by applicable law.

Specific promotional terms may override or supplement these general conditions.

NEW SUBSCRIBER OFFERS

From time to time, Styleware may offer promotional benefits to new email or SMS subscribers.

Offers may vary by country, customer, promotional period or other eligibility criteria and may include discounts, free gifts, early access or other benefits.

Where an offer is available, the applicable benefit and conditions will be displayed through the relevant sign-up form, email, SMS or promotional communication.

Unless otherwise stated, subscriber offers:

  • Are limited to eligible new subscribers.

  • Are limited to one use per customer.

  • Are non-transferable.

  • May be subject to a minimum spend.

  • Cannot be combined with other offers or promotions.

  • Have no cash value.

Availability and terms of subscriber offers may differ by country.

CURRENT PROMOTIONS

Any additional terms relating to a promotion currently offered by Styleware will be set out below or otherwise communicated with the applicable offer.

Free Gift Promotion

Eligible customers may receive a complimentary Set of Minis when the applicable qualifying spend displayed on the Styleware website is reached.

The qualifying spend, eligible countries, gift availability and any exclusions will be displayed with the applicable offer.

Free gifts are strictly available while stocks last and are subject to the Free Gifts With Purchase terms above.

PRIVACY

Styleware respects your privacy and handles personal information in accordance with our Privacy Policy.

Our online store is hosted by Shopify. Shopify processes personal information when customers visit or make purchases from our store, including to provide services based on customers' interactions with our store, Shopify and other merchants.

Information may be shared with Shopify and other third parties, including parties located in countries outside Australia, in order to provide these services.

Our Privacy Policy explains in more detail how we collect, use, disclose and protect personal information, how Shopify processes information in connection with our store, and the choices and rights that may be available to you.

EMAIL MARKETING

Where you choose to subscribe to Styleware email marketing, we may send you information about products, launches, promotions, offers and other Styleware news.

Subscription to email marketing is voluntary and is not a condition of purchase.

You can unsubscribe at any time using the unsubscribe link contained in our marketing emails. Unsubscribing from marketing emails will not prevent you from receiving transactional or service-related communications relating to your orders or account.

MOBILE TERMS OF SERVICE

The Styleware mobile message service (the "Service") is operated by Styleware Pty Ltd (“Styleware”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Styleware’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Styleware through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Styleware. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to STYLEWARE or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Styleware mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

YOUR RESPONSIBILITIES

You agree that information you provide to Styleware, including information provided when placing an order or creating an account, will be accurate and complete.

You are responsible for maintaining the confidentiality of your account information and should not use another person's account without permission.

You must not use our website for unlawful, fraudulent or unauthorised purposes.

WEBSITE USE

The content on the Styleware website is provided for personal and non-commercial use unless otherwise authorised by Styleware.

You must not, without our prior written permission:

  • Reproduce or commercially exploit website content.

  • Use automated data extraction, scraping or data-mining tools on our website.

  • Attempt to interfere with the operation or security of our website.

  • Use our website or content in a way that infringes the rights of Styleware or another person.

While we take reasonable steps to maintain the security and operation of our website, we cannot guarantee that access will always be uninterrupted, error-free or free from harmful components.

THIRD-PARTY LINKS

Our website may contain links to websites, platforms or services operated by third parties.

Unless otherwise stated, Styleware does not control or endorse third-party websites and is not responsible for their content, privacy practices, availability or operation.

SOCIAL MEDIA & USER CONTENT

Styleware operates social media accounts and may use various social media platforms from time to time.

Views expressed by users on Styleware social media pages do not necessarily represent the views of Styleware.

You must not post content to our website or social media channels that is unlawful, defamatory, discriminatory, obscene, misleading, infringes another person's intellectual property or privacy rights, or otherwise violates applicable law.

Where you submit, tag or otherwise provide content to Styleware, any use of that content by Styleware will be subject to applicable law and any permissions or terms agreed in connection with that content.

We reserve the right to moderate or remove content from channels we control where appropriate.

INTELLECTUAL PROPERTY

All intellectual property rights relating to the Styleware website, branding, product designs, photography, graphics, text and other content are owned by or licensed to Styleware unless otherwise stated.

Accessing our website does not grant you ownership of or rights to use Styleware's intellectual property beyond personal use of the website in accordance with these Terms & Conditions.

You may not reproduce, distribute, modify or commercially exploit Styleware intellectual property without our prior written permission.

LIABILITY

To the maximum extent permitted by applicable law, Styleware is not liable for losses arising from circumstances outside our reasonable control or from misuse of our website or products.

Nothing in these Terms & Conditions excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under applicable consumer law.

GOVERNING LAW

These Terms & Conditions are governed by the laws of Western Australia, Australia, subject to any mandatory rights or protections available to customers under applicable law in their jurisdiction.

CHANGES TO THESE TERMS

We may update these Terms & Conditions from time to time to reflect changes to our business, website, products, services, promotions, technologies or legal requirements.

The current version will be published on our website.
